Lawyers Sue Westlaw, LexisNexis Sued for 'Unabashed Copying' of ...

A lawsuit accuses Westlaw and LexisNexis of "unabashed" copyright infringement in selling access to legal documents without permission from the authors -- namely, attorneys from coast to coast.

Two attorneys filed the suit in Manhattan federal court against Reed Elsevier Inc., which owns LexisNexis, and West Publishing Corporation, which owns Westlaw, The Wall Street Journal reports. West is a division of Thomson Reuters.

The legal-database companies "engaged in wholesale unlawful copying of attorneys' copyrighted work, bundled those works into searchable databases, and sold access to those works ... for huge profits," the lawsuit states.

"In doing so, West and LexisNexis are infringing the rights of the very clients they purport to serve," the Westlaw/LexisNexis lawsuit states.

Attorneys Edward L. White of Oklahoma and Kenneth Elan of New York are named as plaintiffs in the suit. They're seeking damages, disgorgement of Westlaw and Lexis profits, and an injunction to stop the alleged infringement.

White registered copyrights for some of his legal documents, but Elan did not. They hope to represent two classes of attorneys in their suit, which seeks class-action status.

The attorneys' copyright-infringement claim "is actually moderately strong" because legal briefs "are protected by copyright the moment they are written," UCLA law professor Eugene Volokh explained at his blog, The Volokh Conspiracy.

"The question is whether the commercial posting of the briefs is fair use," which is arguable, Volokh opined.

Attorneys White and Elan are being represented in their Westlaw/LexisNexis lawsuit by lawyers from two Manhattan law firms. The copyright-infringement complaint was filed Feb. 22, and can be read in its entirety by clicking here.

?Rampage? weight flop costs him; Bader puts him on his back to roll to victory at UFC 144

Quinton Jackson didn't come to Japan ready to fight and it costed him in what he hoped would be a triumphant return. The former PRIDE legend and UFC light heavyweight champ didn't make weight on Friday. When it came time to show his stamina and athleticism, "Rampage" just didn't have it.

Behind a solid clinch game and wrestling, Ryan Bader pulled what turned out to be a mild upset, via unanimous decision, 30-27 on all three cards.

Jackson was a minus-250 favorite in the lead up to the fight. When he showed up at the weigh-in looking soft and tipping the scales at 211 pounds, bettors pounded the Bader side. They were right. Jackson explained that his weight miss was due to an injury during training camp that "kept him from doing his roadwork." Jackson did have a noticeable limp after the fight.

The 33-year-old wound up forfeiting 20 percent of his salary, which was likely around $250,000. That money goes straight to Bader. This was a huge win for the former Arizona State All-American wrestler. Bader has been on the cusp of big things, but was dominated in 2010 by the future division champ Jon Jones and upset last year by Tito Ortiz.

Jackson had one big moment in the fight. Known during his PRIDE days for his powerful slam, Jackson turned back the clock and spiked Bader. The second-round slam had Bader land in an awkward position. It looked like he may have injured his right arm at that point, but Bader said he was fine after the fight.

His performance showed it. He scored takedowns in each round. He didn't land anything too vicious on top but dominated position and made it tough for Jackson to get back to his feet.

Jackson, a native of Memphis, exploded as an MMA star during his time in Japan between 2001-2006.

American Idol rounded out its season 11 semifinalists last night. Almost.

A night after making the dreams of 14 contestants come true, Randy, Steven and J. Lo went through the same process again here, listening to a few final auditions before making their selections. So, who advanced to the top 24? And how is it now the top 25? Read on...

If your political candidate of choice falls behind in the polls, will you lose faith in his ability to win? Probably not. A new study from Northwestern University suggests that people tend to believe that their preferred candidate will win an election, no matter what the polls predict.

The study was published Feb. 21 in the Proceedings of the National Academy of Sciences journal.

"People thought their preferred candidate had a higher chance of winning, in every election, no matter in which state they live, no matter who was running, no matter which political party," said Charles F. Manski, co-author of the paper. "This is one of the strongest empirical regularities I've ever seen."

Manski is the Board of Trustees Professor in Economics in the Weinberg College of Arts and Sciences and a Faculty Fellow in the Institute for Policy Research at Northwestern. Adeline Delavande from the Institute for Social and Economic Research at the University of Essex is a co-author of the paper.

"It appears that Americans, despite having access to the same publicly available information, nevertheless inhabit disparate perceptual worlds," Manski said.

For example, someone who strongly supports a Democrat candidate over a Republican will give a 20 to 30 percent higher chance, on average, that the Democrat would win the election than would someone who strongly supports the Republican.

Manski said that the findings are consistent with a psychological phenomenon called the false consensus effect, in which people project their own preferences onto others.

Previous studies on the false consensus effect have focused on topics in which there exists little or no public information about social preferences. In presidential and statewide elections there is considerable common knowledge of social preferences from poll data, Manski said.

The authors used data from the American Life Panel, an online survey that has been administered to several thousand adult Americans by the RAND Corporation, a policy research nonprofit. They analyzed survey responses collected around the 2008 U.S. presidential election and 2010 senatorial and gubernatorial state elections.

Regardless of gender and level of schooling, people tended to favor the electoral chances of their preferred candidate. The effect was equally strong among white and black respondents. Also, when individuals changed their candidate preferences over time, their expectations of election outcomes changed similarly.

"Many researchers are trying to understand why people vote and how they vote," Manski said. "The false consensus effect might influence voting behavior."

Engineers create a rainbow-colored polymer that could open the door to portable, handheld multispectral imaging devices

ScienceDaily (Feb. 23, 2012) ? University at Buffalo engineers have developed a one-step, low-cost method to fabricate a polymer with extraordinary properties: When viewed from a single perspective, the polymer is rainbow-colored, reflecting many different wavelengths of light.

Used as a filter for light, this material could form the basis of handheld multispectral imaging devices that identify the "true color" of objects examined.

"Such portable technology could have applications in a wide range of fields, from home improvement, like matching paint colors, to biomedical imaging, including analyzing colors in medical images to detect disease," said UB Vice President for Research and Economic Development Alexander N. Cartwright, one of the UB researchers who led the study.

The ease of producing the polymer could make it feasible to develop small devices that connect with cell phones to conduct multispectral imaging, said Qiaoqiang Gan, a UB assistant professor of electrical engineering and another member of the research team.

"Our method is pretty low-cost, and because of this and the potential cell phone applications, we feel there is a huge market for improving clinical imaging in developing countries," Gan said.

Because the colors of the rainbow filter are produced as a result of the filter's surface geometry, and not by some kind of pigment, the colors won't fade over time. (It's the same principle that gives color to the wings of butterflies and feather of peacocks.)

To create the rainbow material, Liu and Xu sandwiched a photosensitive pre-polymer syrup between two glass slides. (A photosensitive substance is one whose physical properties change upon exposure to light.)

Next, they directed a laser beam through a curved lens placed above the pre-polymer solution. The lens divided and bent the laser beam into light of continuously varying wavelengths.

As this light hit the solution, monomers in the solution began joining into polymers, forming a continuous pattern of ridge-like polymer structures. Larger ridges rose where the light struck with more intensity.

The resulting structure is a thin filter that is rainbow-colored when viewed under white light. This is because the periodic polymer layers reflect a continuous spectrum of colors, from red on one end to indigo on the other.

The single-step fabrication method -- shining a laser light through a curved lens -- is affordable and relatively simple.

The filter the researchers created was about 25 millimeters long, but the technique they used is scalable: It's possible to create filters of different sizes by shining the laser through lenses of different sizes.

Gan said the next step for the researchers is to improve the quality of the rainbow filter. The team is also beginning to explore ideas for incorporating the technology into handheld devices.

Liu presented the results of this work with the rainbow-colored polymer grating as a post-deadline paper at IEEE Photonic Annual Meeting in Arlington, Va., in October 2011. The conference is considered one of the premier international events for optics and photonics.

Cartwright and Gan's team reported on their polymer fabrication technique online Feb. 22 in Advanced Materials, an academic journal. Coauthors on the study also include UB students Ke Liu and Huina Xu and UB research scientist Haifeng Hu.

The UB Office of Science, Technology Transfer and Economic Outreach (STOR) has submitted a provisional patent application detailing the production process to the U.S. Patent and Trademark Office.

Waterproof Paint, Plastic Vapor Barrier, Or Concrete Sealer?


What To Use To Control Moisture & Humidity In Your Basement

Generally speaking, homeowners now recognize the importance of creating a vapor barrier on their walls. Whether through waterproof paint, a plastic vapor barrier, a penetrating sealer, or some other method, creating this barrier will prevent water vapor from seeping through the pores of concrete.

In a finished basement, a vapor barrier will protect drywall and insulation from the moisture buildup that would otherwise lead to mold, mildew, and humidity passing through the concrete walls and floors located within the space. In an unfinished basement or cellar, sealing the walls and floor will create a drier environment, protecting stored items from rot and mold, and helping to control that musty smell that's notoriously present in below-grade spaces.

However, there are a lot of basements out there - and a lot of companies competing to earn your consumer dollar on products that will help to control that moisture intrusion. And, like all things in the home improvement industry, some work better than others.

Let's take a look at the three most common methods of moisture control:

1. Waterproof Paint

Most popular among do-it-yourselfers, many homeowners will opt for waterproof coatings and paints that are available at most local box stores. These products sport big promises, low cost, and seductive warranties that make them look like they're a foolproof choice for any basement.

Unfortunately, these products have three major weaknesses:

* A Non-Penetrating Formula: These paints and coatings are surface-level only, and have a comparatively weak bond on your concrete surfaces. If this coating is used on surfaces that are dirty, the will peel off. They are also a weak choice for high-traffic areas of floor, where the surface coating can peel off.

* Poor Resistance To Acidity: There's a lot of chemistry going on in the concrete walls of a basement - and the moisture that passes through may be highly acidic. This is particularly true if your basement walls are new, and haven't completed the years-long curing process. This acidity can break the bonds of surface coatings, causing them to blister and peel off.

* Vulnerability To Efflorescence Buildup: Along with moisture, minerals also pass through your basement walls. As the moisture evaporates or recedes, it can leave these minerals in the form of a white, powdery mineral salt known as efflorescence. As this builds up, it can also compromise the bond of paints and coatings. Read your warranty carefully, and you'll see that it probably doesn't cover walls with efflorescence!

To make matters worse, once these coatings fail, they can be extremely troublesome to remove. You'll be working quite hard on those ugly, blistering, peeling walls - and most likely, you'll be renting some equipment as well!

2. Plastic Vapor Barriers

Whether rigid or pliable, plastic vapor barriers are a good choice for preventing moisture that comes through basement walls. Because they attach mechanically to the walls, there is no concern of peeling or detaching from the walls as there is with waterproof paint. Additionally, this is the only solution that can also intercept water flooding through cracks in the concrete - ones that would otherwise bypass sealers and paint coatings. This flooding water would be directed to a perimeter drain system, presuming you have one in place.

Typically, the seal is made permanent with epoxy or caulk along the top and seams.

Plastic vapor barriers install fairly quickly, and there's no VOC's or drying time to worry about. They can give a basement a brighter, more cheerful appearance, or they can be used behind finished walls.

There are three disadvantages to plastic vapor barriers

* Cost: The cost to buy, cut, and attach plastic vapor barriers can be much higher than simply applying a concrete sealer or waterproof paint.

* Mold Concerns: What happens to the moisture that collects behind this plastic vapor barrier? Many homeowners voice concerns of mold and mildew growth, although there is little scientific evidence to support a health issue of mold behind a sealed vapor barrier.

* Not Ideal For Floors: While this is a great option for the walls, it's a less-than-impressive option for the floors. On a very flat floor, plastic floor tiles (without chipboard present) can be a possible vapor barrier substitute, but these tend to click and make noise on less even surfaces.

Despite the disadvantages, these vapor barriers provide a permanent solution, where applicable, and could be considered for moisture control in many homes.

3. Concrete Sealers

For the purpose of this article, we'll discuss sliane-based concrete sealers. These sealers penetrate deep into the pores of the concrete, activating with the minerals in the concrete to create a glasslike barrier deep within the concrete. They're safe to use indoors, and contain little or no VOC's (brand depending).

Sliane-based concrete sealers activate quickly, and can be applied to both cured and newly-placed concrete. They will not change the appearance of the concrete, efflorescence and acidity will not harm them, and they're able to be painted over with ease. Installation is fast (done with a brush, roller, or sprayer), and they're middle-of-the-road in overall cost.

Three disadvantages to consider are as follows:

* Provides Moisture Control ONLY: Unlike plastic vapor barriers, this will not be able to breach cracks or stop flooding water. It's meant only as a sealer for water vapor that would otherwise pass through the pores of the concrete.

* Take Care When Installing: Sliane-based sealers cause etching on glass, should they come in contact with it. When installing, be sure to protect and/or avoid glass surfaces.

* Possible to Overapply: Waterproof paints can be coated thickly, thinly, or in multiple layers, and it's impossible to overapply a plastic barrier. But an installer should be careful to only use enough sliane-based sealer to damp the concrete, as too much will leave a white residue behind.

Sliane-based sealers are the ideal choice for basements that are damp but do not flood, as they are inexpensive, install quickly and subtly, and provide a lasting solution.

Curb the car dashboard technology, government asks

(AP) ? Auto dashboards are becoming an arcade of text messages, GPS images, phone calls and web surfing, the government says, and it's asking carmakers to curb those distractions when vehicles are moving.

Manufacturers have been loading up higher-end vehicles with an array of built-in gadgets in an effort to tempt car buyers who want to multi-task behind the wheel in today's increasingly connected society. But the technological advances have raised concerns that drivers' attention is being diverted too much from the road.

The National Highway Traffic Safety Administration on Thursday proposed voluntary guidelines for manufacturers, including a recommendation that they design dashboards so that distracting devices are automatically disabled unless the vehicle is stopped and the transmission is in park.

"We recognize that vehicle manufacturers want to build vehicles that include the tools and conveniences expected by today's American drivers," said NHTSA Administrator David Strickland. "The guidelines we're proposing would offer real-world guidance to automakers to help them develop electronic devices that provide features consumers want without disrupting a driver's attention or sacrificing safety."

Gloria Bergquist, vice president of the Alliance of Automobile Manufacturers, said carmakers will review the guidelines, which have a 60-day comment period. She noted that the industry has had its own voluntary guidelines since 2002.

"Drivers are going to have conversations, listen to music and read maps while driving, and automakers are helping them do this more safely with integrated hands-free systems that help drivers focus on the road," Bergquist said.

The guidelines, which are directed at passenger cars and sport utility vehicles, would exempt safety devices such electronic-warning systems that alert drivers to potential collisions or lane changes. GPS and other navigation devices that provide directions would also be permitted while driving, but the safety administration is asking that the systems be designed so that drivers can't manually enter a destination unless the car is in park.

The alternative is for drivers to go back to studying maps while they drive, which is even less safe, Strickland said.

Bergquist, of the carmakers, cautioned about preventing addresses from being entered into GPS devices unless the vehicle is stopped.

"There are often passengers in the car who can enter addresses, so we need to consider that when looking at requiring these technologies to only be used in park," she said. "And if the GPS is disabled when moving, consumers can always bring their own Garmin into the vehicle. It's complicated."

Other dashboard technologies recommended for automatic disabling include text-messaging, Internet browsing, social media browsing, phone dialing and computer screen messages of 30 characters or more that are unrelated to driving.

The guidelines would make exceptions for these devices if they are designed only for use by passengers and can't be accessed or seen by the driver.

Manufacturers are also urged to take steps to make technologies safer that drivers are allowed to use while driving. That includes reducing to two seconds or less the amount of time drivers must divert their eyes from the road to use a device. Devices should also be designed so that drivers don't have to use more than one hand or glance through extraneous information.

The guidelines are a good first step toward reducing driver distractions, said Barbara Harsha, executive director of the Governors Highway Safety Association, which represents state highway safety offices.

But "the safest thing is for drivers not to use these systems at all ? both hands on the wheel and the mind focused solely on driving," she said.

Anne Fleming, senior vice president of the Insurance Institute for Highway Safety, an industry-supported safety research group, said it's good that NHTSA and automakers are working together, but it "will be very hard to measure whether it's reducing distraction and whether it's reducing it enough."

One reason NHTSA decided to pursue voluntary guidelines instead of mandatory rules is that officials wanted to do something quickly, Transportation Secretary Ray LaHood told reporters in a conference call. The process for writing federal rules often takes years to complete.

The guidelines are also a way "to continue the drumbeat" that distracted driving is a serious safety issue that costs lives, said LaHood, who has been vigorously campaigning on the subject for more than three years.

NHTSA is also considering future guidelines to address portable electronic devices drivers carry with them in cars, including GPS navigation systems, smartphones, and electronic tablets and pads.

In December, the National Transportation Safety Board, which investigates accidents, said that texting, emailing or chatting on a cellphone while driving is simply too dangerous to be allowed and urged all states to impose total bans except for emergencies.

That recommendation was inspired by recent deadly crashes, including one in which a teenager sent or received 11 text messages in 11 minutes before an accident. There were an estimated 3,092 deaths in crashes affected by distractions in 2010.

Currently, 35 states and the District of Columbia ban texting while driving, and nine states and the District of Columbia bar hand-held cellphone use. Thirty states ban all cellphone use for beginning drivers. But enforcement is generally not a high priority, and no states ban the use of hands-free devices for all drivers.

Texting while driving increased 50 percent in 2010, the most recent year for which data is available, according to NHTSA. A government survey of drivers found that two out of 10 say they've sent messages from behind the wheel ? and that spikes much higher among young adults.

AAA said it's important to ensure that dashboard technologies aren't simply making it more convenient and more appealing to drive while distracted.

"Available research evidence is extremely limited and highly inconclusive on the real risks that in-car communications technologies pose to drivers, even when systems are limited to voice-activation only," said AAA CEO and President Robert L. The Mexican-American eventually earned a spot in Sabor, a veteran club band that made most of its dough from the weekend wedding circuit. There wasn't much hope beyond local recognition, until one mid-December night, when a man named Ernie Steele stumbled into Sanchez's set at the Latin Press Club in Pico Rivera.

"In walks this cigar-smoking white guy with a funny feathered hat. He stuck out like a sore thumb," says Sanchez, who tells stories like he plays the congas: rapidly, with impeccable timing and improvisational flourishes. "I take a break and [Steele] is at the bar next to me, saying, 'Man, you can really play.' He asks if I want a drink and I say, 'Yeah, if you're buying.' Then over Harvey Wallbangers, he starts telling me how he's a personal friend of Cal Tjader."

Convinced that Steele was bullshitting, Sanchez cracked that he should be sure to mention his conga work to Tjader, who was Sanchez's idol. Later, he and his band laughed at the absurdity of the flamboyant gringo being buddies with the Bay Area master of mambo. Except that the next week Tjader happened to be performing at Concerts by the Sea in Redondo Beach, and none other than Steele was sitting in the front row. During a set break, the mysterious Steele corralled Tjader and waved Sanchez down from the balcony, where he and his wife had paid to sit.

MONDAY, Feb. 13 (HealthDay News) -- Patients with a history of heart disease will most likely not reduce their risk for developing cancer by taking vitamin B and/or omega-3 fatty acid supplements, a new French analysis suggests.

"In the population we studied, we found no beneficial effects of either B vitamins or omega-3 fatty acids taken over five years on cancer occurrence or cancer-related death," noted study author Valentina Andreeva, who is with the nutritional epidemiology research unit at the University of Paris XIII in Bobigny, France.

Andreeva and her colleagues report their findings in the Feb. 13 online edition of the Archives of Internal Medicine.

To explore the protective potential of B vitamins and fatty acid supplements, the authors did a secondary analysis of data that had been collected in a previous study involving almost 2,000 French men and 500 women.

All were between 45 and 80 years of age, and all had experienced cardiac trouble (heart attack, unstable angina or ischemic stroke) in the year leading up to the start of the study.

In turn, the participants were divided into one of four different groups that consumed a daily supplement regimen involving various types of vitamin B and omega-3 fatty acids at "relatively low supplementation doses."

By the end of the original five-year study, 7 percent of the participants had gone on to develop some form of cancer, and just over 2 percent ultimately died of cancer. The vast majority of cancer cases (including prostate, lung, bladder and colorectal cancer) and deaths occurred among men (81 percent and 83 percent, respectively).

The team unearthed no evidence that any form of vitamin B or omega-3 fatty acid supplement improved cancer outcomes in any way.

The investigators noted that there were some indications that cancer risk might have actually gone up, specifically among women taking vitamin B and/or omega-3 fatty acid supplementation. However, the authors stressed that this observation was based on too few cases to substantiate a firm conclusion, and called for further research involving a larger pool of participants.

"The results of our study suggest that individuals should exercise caution when deciding to take dietary supplements, especially over a long period of time and without a physician's advice," advised Andreeva. "Such supplements constitute active substances and might have adverse effects in some populations. To be on the safe side, individuals should strive to achieve dietary recommendations via healthy, balanced diets."

Joseph Su, the Washington, D.C.-based program director of the division of cancer control and population science within the U.S. National Cancer Institute's epidemiology and genomics research program, said that nothing about the findings struck him as surprising.

"So far, study findings have been very inconsistent," he noted. "But most supplement studies, if anything, have shown no beneficial effect whatsoever. Just like this one. So, I don't think there's anything that can really back up the idea that these supplements can prevent cancer."

However, Vicky Stevens, strategic director of laboratory services at the American Cancer Society in Atlanta, expressed some reservations about the French analysis.

"Compared with other trials, they used much lower levels of supplements," she noted. "From the B-vitamin point of view, dramatically lower. So, it could be argued that they just weren't using high enough levels of supplements to see any effects," Stevens suggested.

"And they used a natural form of folate [vitamin B supplement], whereas other trials use a synthetic form," Stevens added. "But the real problem in being able to evaluate the effects they do see is that they don't have enough people. And it's not really a long enough follow-up period to really see an effect of these supplements on cancer onset. Five years isn't really enough. It can take 10 or 20 years in most cases. So, what they may be seeing is an effect on preexisting abnormalities, but not the impact on cancer onset itself."

Duffy MacKay, a naturopathic doctor and vice president of scientific and regulatory affairs for the Council for Responsible Nutrition in Washington, D.C., agreed.

"When you look at an intervention like this, you're definitely not looking at the role of the supplements at preventing tumors, because the tumors likely started well before the trial," he noted. "So really what the trial is about is giving vitamin B and omega 3 and seeing if they altered the outcome, the progression, of these cancers," MacKay explained.

"And with that you have to realize that cancer is a very complex multi-factorial disease," MacKay stressed. "And two supplements would never be expected to be a successful treatment on their own. I would say, however, that proper nutrition is one of your best allies in terms of wellness, period. And while no one ever claimed these were cancer drugs, if you will, supplements make sense, cancer or no cancer."
